Terms of Service

1. Acceptance of Terms

By accessing or using Brand Clubb ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Brand Clubb provides a platform for Shopify merchants to create and manage ambassador and affiliate programs. The Service includes tools for tracking sales attribution, managing commissions, building branded websites, and running marketing campaigns.

3. Accounts & Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

Each tenant (brand account) may have multiple team members with different roles (owner, admin, member). Account owners are responsible for managing team access and permissions.

4. Subscriptions & Billing

Brand Clubb offers paid subscription plans billed monthly. All plans include a 14-day free trial. No credit card is required to start a trial.

• Subscriptions renew automatically at the end of each billing period
• You may cancel your subscription at any time through the billing portal
• No refunds are provided for partial billing periods
• We reserve the right to change pricing with 30 days' notice

5. Shopify Integration

By connecting your Shopify store, you authorize Brand Clubb to access your store data as described in our Privacy Policy. You represent that you have the authority to grant this access.

Brand Clubb creates discount codes in your Shopify store on behalf of ambassadors. You are responsible for ensuring these discount codes align with your business policies.

6. Ambassador Programs

Merchants are solely responsible for their ambassador relationships, commission structures, and payouts. Brand Clubb provides the tools to manage these programs but is not a party to any agreement between merchants and their ambassadors.

Brand Clubb does not process payments between merchants and ambassadors. Payout processing is handled through third-party services (e.g., PayPal) configured by the merchant.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload malicious code or attempt to compromise the Service
• Interfere with other users' use of the Service
• Scrape, crawl, or otherwise extract data from the Service
• Impersonate any person or entity

8. Content & Intellectual Property

You retain ownership of all content you upload to the Service (images, blog posts, brand assets). By uploading content, you grant Brand Clubb a limited license to host and display it as part of the Service.

Brand Clubb and its logos, design, and code are the intellectual property of Brand Clubb. You may not copy, modify, or distribute any part of the Service without permission.

9. Limitation of Liability

Brand Clubb is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, lost data, or business interruption. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Upon termination, your data will be retained for 30 days before deletion, unless you request immediate deletion.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
